And it's very heartening to see how businesses come in and sometimes are doing fine, and sometimes they're struggling, and then do things, and they get stronger and stronger. And each month they say, "Well, I can do a little more. I can do a little more." And they have the appropriate guidance to make the decisions. For example, part of it can be looking at something like if you're selling 10 different items and you're making a profit, and you say, "Well, okay, I'm doing okay." When we look at each item by itself, we might find that seven items are profitable and three are not. And then we either have to adjust the prices on those, or stop selling them. So we do more money with less work, and we use the time for something else. And we keep adjusting and adjusting. That's true with measuring personnel performance, equipment performance, and planning. For example, a lot of companies will wait until the last minute to hire somebody, and then it's a rush, and there's a challenge. What we do is we measure things and we say, "Okay, look, it looks like in the future, you're going to need to somebody else, and you're progressing so much a month, about this time is when you should start looking so when you need them, then you can go ahead and choose the proper person, and he or she can fit into the job, not somebody that's just put in because you needed somebody." And we just see this time after time, and incident after incidents. It's not just taking the time, but guiding you and showing you, look, change this, change this. You see the changes much like artillery. You take some shots, and it goes left and it goes right. We want to hit the target, and that's what we do. And again, it's just so rewarding to us when we see those profits going up and up and up. That's why sometimes I call this profit optimization, because we go ahead and we just see the difference in clients' results. - [#14 | Pension Planning](https://moskowitzllp.com/practical-tax/episode-14-pension-planning/): In this week's episode of the Practical Tax Podcast, Steve Moskowitz sits down to discuss Pension Planning with Stephen Dobrow; the President of Primark Benefits. And just this month, it was modified in SB113 to make it even better. So here's the deal. Don't wait for one of these new IRS agents to come knocking on your door and ruin your life, your business, and your marriage. You have so many rights and so many good options. For example, you may ask for an Offer in Compromise and only pay part of what you owe. There are three grounds for Offer in Compromise. The first is doubt as to collectibility. That means you don't have sufficient income and assets to pay your taxes. The second ground is doubt as to liability. That is, if you don't believe you owe the tax, or you don't believe the amount is correct. The third ground is a compassionate one, where it would be considered unfair to collect the taxes. An example of this could be seen for an elderly or an ill person, where it would just be unfair to take anything away from them at this point in their lives. - [Are You Ready for Tax Day? IRS Counsel even attempted to dismiss the electronic confirmation because it didn't display a software logo. - [ERC Appeals](https://moskowitzllp.com/success-story/erc-appeals/): Many taxpayer clients have come to our firm with IRS denial letters for the taxpayer's ERC filings. Multiple of these clients had the tax 2021 Quarter 3 denied. We feel the IRS were issuing blanket rejections of this quarter due to certain state and local governments lifting governmental orders previously imposed due to COVID safety. Our appeals have been successful, resulting in the IRS releasing tens to hundreds of thousands in ERC refund to our clients. - [ERC Audits](https://moskowitzllp.com/success-story/erc-audits/): We have successfully represented taxpayers in audit where the IRS is seeking to take back the refund already received by our clients. Our representation resulted in no change and the taxpayer clients did not have to return any monies. - [ERC Expedites](https://moskowitzllp.com/success-story/erc-expedites/): Many business taxpayers came to our firm dealing with the IRS's lack of processing their ERC credits. We successfully advocated for our clients with the Taxpayer Advocate Service, local congresspeople, and other IRS avenues. We have been successful securing those refunds for our clients including multiple clients receiving credits over $1.5M. - [ERC Apply](https://moskowitzllp.com/success-story/erc-apply/): Our firm has successfully applied for ERC credits for our clients including multiple clients receiving over $1.5M in ERC credits plus interest. - [California Franchise Tax Board (“FTB”) Audits](https://moskowitzllp.com/success-story/california-franchise-tax-board-ftb-audits/): Our office has successfully advocated for our clients in audits where the result was no change on the tax returns. Additionally, multiple clients came to our firm acknowledging the FTB's position was proper and sought our assistance in representing them to close the audit and continue with the eventual collections representation. Instead of resigning our client to agree with the FTB, we examined the client's returns and records and successfully reduced any new potential liability from the audit. Sample cases include: the FTB taxing an out-of-state shareholder taxpayer who did not report on its non-resident California return the proceeds from $40m+ business sale. We reviewed prior tax returns and determined prior business losses from sales of subsidiary businesses were not used. The FTB auditor accepted use of those losses, which reduced any additional FTB tax liability of tens of thousands of dollars. Another case included the taxpayer client reporting a sale of his home, where he reported a high tax cost basis, which reduces taxable income, on the advice of a prior tax professional. The property had gone through multiple sales and 1031 like-kind exchanges prior the client receiving the property as a gift. Instead of accepting the FTB's reduced tax basis, we determined the property had hundreds of thousands of property improvements that weren't reported on the return, which if they were, would have increased basis and reduced the taxable income. Additionally, we found the prior tax preparer reported real estate rental income on two separate schedules on the return, thereby reporting the taxable income twice. The FTB auditor again agreed, and that additional income was removed. - [Collections: Removal of old tax liability years after the fact](https://moskowitzllp.com/success-story/collections-removal-of-old-tax-liability-years-after-the-fact/): Taxpayer came to our firm with over $30k in liability from a tax return where the IRS made a "quick change" (an adjustment on a return that is not from an audit) on a tax return filed five years prior from our representation. The IRS stated our client did not report stock sales from Incentive Stock Options ("ISO") and the taxable income the sales generated. After reviewing the IRS notice, the tax return, and financial information provided, we determined the ISOs were in fact Disqualified ISOs, which has different tax treatment as ISOs. Since Disqualified ISOs are already included in wage income, the IRS's "quick change" resulted in double-taxing the client. We reached out to the IRS and presented our case citing the differing tax treatment and the substantiation we had to prove our position. The IRS response was to remove the entire liability; meaning the client no longer owed any money to the IRS. - [Tax Court Victory – Collections Case](https://moskowitzllp.com/success-story/tax-court-victory-collections-case/): The client came to our Office with a tax liability already in collections. The clients timely filed a Collection Due Process request in response to a notice of intent to levy, requesting a suitable installment agreement. The IRS agent denied our clients' request for an installment agreement and issued a Notice of Determination sustaining the IRS's intent to levy. Our office petitioned the U.S. Tax Court in response to a Notice of Determination arguing improper review of our clients' installment agreement requests amongst other deficiencies. After the IRS answered the petition, our office filed a Motion to Remand with the Court requesting the Court send the case back to appeals to review, arguing Appeals abused its discretion in coming to its determination. It is difficult for taxpayers to win on these motions, but after oral argument, the Court, citing IRS appeals agent's improper review, remanded the case back to Appeals so the clients can have its case heard again by the IRS agent. You can see the Court's opinion here: https://www.taxnotes.com/research/federal/court-documents/court-opinions-and-orders/collection-case-remanded-appeals-consider-ability-pay/7l5df  - [Employer Development Department (“EDD”) Petition for Reassessment (late filing):](https://moskowitzllp.com/success-story/employer-development-department-edd-petition-for-reassessment-late-filing/): Client came to us with over $190k EDD payroll tax liability already in collections with the EDD threatening to levy the client's personal bank accounts and lien the client's personal property. Another business, a C Corporation, not the Client's and he did not work there then and during the periods at issue, was under EDD audit. The EDD auditor thought it was our client, even claiming to speak with him, that employed over six employees and did not report and pay payroll taxes. Client did not know of the audit; was never visited by the EDD agents; and never received notices. EDD issued a Notice of Assessment in the Client's name, supposedly operating as a sole proprietor, and mailed the notice to the business address of the original business subject to the audit. The client had 30 days to appeal the proposed assessment, but the Client did not know there was a notice until nine months later. Thus, 240 days (eight months) had passed the deadline to appeal. Our office petitioned for reassessment with the Office of the Chief Administrative Law Judge and California Unemployment Insurance Appeals Board acknowledging the petition was untimely by 8 months but arguing the client was not given proper notice, never was contacted during audit, and not the subject to the audit. Untimely petitions are rarely successful in getting the ultimate arbiter to client's petition for reassessment. However, the Administrative Law Judge ("ALJ") heard our oral arguments and granted in the client's favor citing lack of proper service by the EDD. The $190k debt is now out of collections as the client has now officially disputed the proposed assessment because the ALJ determined the untimely petition was deemed timely - as if the petition was filed within 30 days from assessment notice. - [Tax Court Victory](https://moskowitzllp.com/success-story/tax-court-victory/): IRS attempted to assess over $408k in additional tax and over $81,000 in penalties for an approximate total of over $490k. This does not include interest that would have started accruing since 2019. The case surrounded whether the client actively participated in real estate activities. If the client was deemed to be a passive actor in the real estate activity, the client would have been limited in real estate losses and other deductions. The result of our tax court representation ended with $0 added liability for the client as we successfully presented our case to IRS counsel and it agreed with our position. - [ERC Restaurant Success](https://moskowitzllp.com/success-story/erc-restaurant-success/): Client is a successful restaurant offering indoor and outdoor sit-down and carry-out service. During the pandemic, the city allows the restaurant to remain open provided that all tables in the indoor dining room must be spaced at least six feet apart. The client mistakenly believes that because the restaurant remains open during the pandemic and its gross receipts are more than 50% of its gross receipts before the pandemic, the restaurant is not eligible for the Employee Retention Tax Credit. - [Corporate Dissolution](https://moskowitzllp.com/success-story/corporate-dissolution-success-story/): Client’s restaurant and brewery was losing money in 2017 and 2018, falling behind on bills and payroll taxes. The decision was made to close the business. Shortly after the business shuttered its door, the IRS came knocking. The client consulted with us about what he needed to do in light of the debts still owed by the corporation. We advised him on the proper ways to close the corporation so that the liabilities stayed inside the shell of the closed corporation. We followed the California Corporations Code to inform all shareholders and interested parties of the scheduled board meeting to close the corporation. A minority shareholder, requested a review of information and books, because he did not want to lose the ability to get a free beer when visiting the area, per his shareholder agreement; despite the fact that the restaurant was already shattered. We guided the board meeting to a successful resolution, resolving the concerned minority shareholder’s concerns. ## Ask a Tax Lawyer - [Unfiled Tax Returns: Don’t Let IRS Troubles Ruin Your Life](https://moskowitzllp.com/ask-a-tax-lawyer/unfiled-tax-returns-dont-let-irs-troubles-ruin-your-life/): Have you neglected filing your tax returns for years, fearing the consequences? Luckily, much of this fear is completely unfounded. - [Why do I Need Representation?](https://moskowitzllp.com/ask-a-tax-lawyer/why-do-i-need-representation/): Why do you need representation when fighting the IRS? It’s simple. You aren’t an experienced professional in the field, and you are going up against someone who is. That immediately puts you at a disadvantage – much like stepping into a ring with a professional heavyweight boxer while not being one yourself. - [Don’t Let a Tax Problem Ruin your Life](https://moskowitzllp.com/ask-a-tax-lawyer/dont-let-tax-problem-ruin-life/): A lot of problems arise when you face legal issues with your taxes. But the biggest problem is getting stuck in the mindset that you can’t do anything about it. Bay Area Tax Attorney Steve Moskowitz has tragically witnessed this first hand: once representing a widow whose husband committed suicide, largely because his financial and tax problems were overwhelming. Another man gave up his child for adoption, thinking he was saving the child from his own tax problems. - [How Can I Tell a Good Lawyer From All the Rest?](https://moskowitzllp.com/ask-a-tax-lawyer/can-tell-good-lawyer-rest/): A good lawyer is someone that will do for you what he or she would do for himself/herself. I called their office and got to speak to an attorney immediately she really took her time with me and walked me through the IRS procedures and explained the initial process of working with their firm. When I had my consultation with Steve I was so relieved to hear that this was common and fixable! I would highly recommend this firm to anyone!! - [Izzy Z.](https://moskowitzllp.com/testimonials/izzy-z/): My grandmother was having trouble with her taxes and hadn't filed in quite a few years...we didn't even know this was the case!   We got a letter from the IRS and were completely surprised!   We googled around and came across Moskowitz LLP and a few other firms. We talked to them all but they stood out of the bunch. My mom and I got on the phone with Steve and he assured us that they could easily help us and saved us a ton of money in the end... Considering how worried we were before and how relieved we are now I would say it was well worth the call. We weren't local but they accommodated us as well which was huge for us. I just wanted to say thank you for helping us and my grandmother!! - [Bobby R.](https://moskowitzllp.com/testimonials/bobby-r/): I would highly recommend Moskowitz LLP to all small businesses who need assistance with their yearly filings. Go with Steve and his team - they will not let you down. Hire them today. - [Sally C.](https://moskowitzllp.com/testimonials/sally-c/): I am not a long-term client of this firm but I just recently started using their tax prep services. (They do more than just tax law!)   First of all, I was pleasantly surprised with how easy it was to work with them. I have the perception of law firms charging an arm and a leg even if you do a lot of the work getting all the info/documentation over but they pretty much took the work out of my hands.   Second, the entire staff was extremely friendly and when I had a question I was able to reach someone immediately. They filed everything early and communicated effectively with me the entire process.   Really pleased with the overall service and I will definitely continue to use them to prepare my taxes every year! - [Christopher B.](https://moskowitzllp.com/testimonials/christopher-b/): When what I thought to be a simple tax matter unraveled into something far larger I was referred to Steve Moskowitz' firm by my father in law. I had a phone consultation with Steve and he promised that my looming tax problem could be fixed rather easily with my cooperation. After I provided them with my part and they worked their 'magic' my issues were resolved and I was able to reduce my tax debt. After the case was settled and my return filed I actually received a refund! - [Nicole B.](https://moskowitzllp.com/testimonials/nicole-b/): I was born and raised in Switzerland but have been an American citizen for many years.   A few years ago, I inherited some funds and property from my family. Because of the complex legal system and tax structure of this country, I wanted to make sure it would be properly handled. I am so happy I selected Steve's firm. From the first day, when I met Steve and his staff, I knew a well-qualified, persistent team of dedicated professionals would successfully represent me. Their assistance in dealing with the complex issues of my case put me immediately at ease. I was kept informed as they went though the various phases of resolving my case.   I highly recommend the firm and staff of MOSKOWITZ, LLP. - [Alamenda B.](https://moskowitzllp.com/testimonials/alamenda-b/): Moskowitz LLP helped me get my tax situation in order after years of ignoring my problem and now I feel so much better knowing this monkey is off my back. Erin facilitated my case very well- keeping me in the loop and following up with me consistently because they know people like me need that kind of attention. I am now much better informed about my obligations as a tax payer and plan to return to Moskowitz LLP for my yearly tax return preparation. - [Ishtar P.](https://moskowitzllp.com/testimonials/ishtar-p/): I called last week to inquire about music taxes and I was able to speak with an associate (that never happens). I believe her name was Erin. She was very professional and knowledgeable about the law firm and all the different services they provide. She even made me laugh. I'm looking to step out on my own and she made me feel very comfortable. When that time is right I will be giving Moskowitz a callback. Thanks for all your help. - [Angel R.](https://moskowitzllp.com/testimonials/angel-r/): I hadn't filed taxes in a few years and wasn't sure if I owed or if I could just start filing again. I called and asked for some advice and spoke with an associate in Steve's office. I was so surprised at how helpful they were about my dependents, what forms to use and what information I needed.  I give this firm 2 thumbs up! - [Kelly M.](https://moskowitzllp.com/testimonials/kelly-m/): I needed some help with a simple tax issue as well as future tax planning, and Moskowitz LLP was a great find! They helped solve the original issue very quickly and easily. Additionally, their team was helpful in advising best practices/planning as I started a business. They were professional, efficient and available, and I felt very informed throughout the process.   I would recommend them to anyone with tax problems, major or minor, as well as someone looking for a company to prepare taxes for you. - [Alicia D.](https://moskowitzllp.com/testimonials/alicia-d/): I reached out to Moskowitz LLP, based on numerous recommendations from friends, to help me deal with some foreign property I had inherited and sold. I have been exceptionally pleased with the high level of customer service I have received from the numerous staff I have interacted with. Everyone who I dealt with was extremely professional and responsive, either in person, via phone or email.   They answered all my questions while providing me with the appropriate legal and tax advice. While I originally contacted them for property tax advice, based on the fact that they far exceeded my expectations, I have now engaged them to file my taxes going forward. I highly recommend Moskowitz LLP for your property and tax preparation and advice. - [Peter S.](https://moskowitzllp.com/testimonials/peter-s/): Not to bore you with details, but I was facing some legal issues due to bad accountants. I called Moskowitz and from my first conversation with Stephen, I knew I was in good hands. My tax issues were solved quickly, efficiently, and for a reasonable price by a team of seasoned professionals. I am extremely happy with the outcome as I got a second chance to do things right. Thank you guys. I will recommend you to all my friends. - [Sami W.](https://moskowitzllp.com/testimonials/sami-w/): Mr. Moskowitz is knowledgeable, down-to-earth, very helpful and friendly. I was referred to Stephen by a friend who spoke very highly of him. Mr. Moskowitz answered all my questions and gave me tips on how to be more organized with my taxes. I would highly recommend this office. - [Patricia P.](https://moskowitzllp.com/testimonials/patricia-p/): Moskowitz is the place to go, period.   Do not go see the IRS, do not speak to them; instead, turn everything over to Steve and his team.   The US tax system is its own ecosystem. One can be a financial and math wizard - but that won't help. Only US tax experts are able to understand the arcane procedures and terminology that exist only in this ecosystem. Steve and his staff are experts.   Don't hesitate and for heaven's sake don't wait! The cost of Steve's services pale in comparison the loss of your time, the stress, and the potentially incorrect charges the IRS may levy. The IRS is known to overcharge for taxes and fees not owed, but mere mortals are unable to discern the difference. - [Kathleen H.](https://moskowitzllp.com/testimonials/kathleen-h/): I contacted this office for a consultation on a relatively-obscure legal issue. His assistant arranged for Mr. Moskowitz to call me back at a time convenient to me, which was a very pleasant surprise; I expected several days of phone tag. Then, when I did speak with him, he was clear, courteous, and - most important of all - very helpful!   It turned out that I didn't need to retain his services; instead, the fifteen minutes that he spent with me on the phone were adequate to resolve my specific issue. I will definitely return to this firm when I have any significant tax concerns in the future! - [Moni B.](https://moskowitzllp.com/testimonials/moni-b/): Moskowitz LLP is a great firm. In the legal field, it's difficult to find a group of people that you can work with who actively listen. I went with low expectations since I've had bad experiences in the past. I felt safe, reassured and hopeful when I left. The staff carefully listened, were empathetic and devised a plan for me to move forward using dynamic solutions that others had not thought of. Without a doubt, I will be returning annually! ## Professionals - [Stacy Lusk](https://moskowitzllp.com/professionals/stacy-lusk/): Stacy Lusk is a highly experienced Certified Public Accountant with over 25 years of professional expertise in accounting, tax planning, and financial reporting.  As Lead Tax Accountant at Moskowitz LLP, she plays a central role in advising individuals and businesses on complex tax matters and strategic financial planning.  Stacy has worked extensively across a range of industries, including real estate, construction, hospitality, healthcare, and nonprofit organizations—delivering customized solutions that meet the unique needs of each client. - [Travis DeLucenay](https://moskowitzllp.com/professionals/travis-delucenay-jd-cpa/): Travis DeLucenay brings over twenty years of combined legal and accounting experience to Moskowitz LLP, offering clients the rare advantage of counsel who is both an attorney and a Certified Public Accountant. Here are some strategies to implement before December 31st. At the end of every year, many individuals come to our tax firm seeking ways to legitimately minimize or defer their tax liability. Although tax planning should ideally be done regularly throughout the year, it’s not too late to implement some tax-savings strategies at year-end. The tax law firm, Moskowitz LLP provides a full range of in-depth, representation to taxpayers seeking to maximize their tax savings. Our dedicated and highly experienced team of tax attorneys and accountants are committed to helping you reduce your tax bill. “There is no reason for you to pay any more than you have to,” says attorney Moskowitz, “meeting with us before year-end could reduce your tax liability considerably.” Here are some suggestions for you to consider through the end of 2018: Give to charity Although the new tax law eliminated many itemized deductions, the charitable giving deduction is still alive and well. You have many options that could benefit others and save you tax dollars at the same time. Here are a few: If your annual donation is less than the new tax law’s increased standard deduction, consider “bunching” your annual donations, itemizing in 2018 and taking the standard deduction next year. You can also donate a piece of art or other collectible and deduct its current fair market value without having to pay tax on the appreciation, and/or use a charitable remainder trust (CRT) to convert a nonproductive asset into a lifetime income stream. If you are 70½ or older, you can also reduce your 2018 taxable income by designating a charity as a beneficiary of your retirement plan. Bunch other itemized deductions Bunching isn’t limited to charitable donations. To increase your tax deductions in 2018, you can also apply this strategy to other itemized deductions, including but not limited to medical and dental expenses. Prepay tax deductible expenses If you make estimated state and local tax payments, consider paying them in advance. Also look at your other expenses, including claims that may have been made against you, to see if it would be beneficial to pay this year rather than next. Keep in mind that in certain circumstances there are tax and other advantages to pre-paying contested taxes and suing for a refund afterwards. If you pay tax deductible expenses by credit card in December of 2018, you can take the deduction this year even if you pay off your card in January! Make retirement plan and health savings account contributions The new tax law did not change the rules regarding retirement plan contributions, so you can still lower your taxable income by making contributions to your 401(k) plan before the end of the year. In addition, taxpayers who contribute to a health savings account (HSA) can deduct $3,450 (individual) and $6,900 (family) in 2018. Add $1,000 to those amounts if you’re 55 or older! Defer some of your income to next year You can also reduce your 2018 tax bill by deferring some of your taxable income to next year. For example, you may wish to consider (1) talking to your employer about deferring your year-end bonus to January, (2) deferring any debt cancellation (partial or full forgiveness of a debt you owe), and (3) restricting your annual retirement payment to the required minimum distribution (RMD) amount. Reconsider your year-end marriage and divorce plans Keep in mind that for U.S. tax purposes, your marriage status on December 31st is your status for the entire year – in addition to avoiding the marriage tax penalty, there are tax benefits for unmarried people who share a mortgage. The alimony rules will also change in 2019 (no more deductions for alimony payments!), so think about planning your marriage or divorce accordingly. Meet with your tax professional now! A qualified tax professional can help you determine which of these last-minute tax savings vehicles applies to you, including making sure that you are properly timing your income, expenses, and capital gains and losses. *** The tax lawyers and other financial professionals at Moskowitz, LLP offer comprehensive assistance to businesses large and small, including year-end business tax planning services.
