As you know, the Justice Department's top priority continues to be its offshore tax evasion initiative. Of particular interest to us (and that made us think of you) is how the DOJ is now utilizing information gathered from investigations and the voluntary disclosure programs. For instance, you may have followed the trial, USA v. Desai (Northern District of CA- San Jose) where the taxpayer was found guilty failing to file FBARS, filing false tax returns, and aiding in the preparation of false tax returns. As part of the trial, the government called an HSBC employee who had FBAR problems of her own. The defense prepared itself to deal with the HSBC witness by interviewing and investigating the government witness's tax preparer.

As tax practitioners these strategies raise questions as to:

  • What agreements were reached in the witness's own tax issues?
  • What are the potential issues for the tax preparer in regards to the witness?
  • What was the tax preparer's strategy when communicating with the US Attorney's Office and Desai's defense team?
  • Penalties, Penalty Defense, and Penalty Litigation
